1. Overview

By accessing and using StackBuddy ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

1.2 Description of Service

StackBuddy is a web-based tool that helps Substack writers schedule and manage their notes. The Service includes:

• Note scheduling and queue management
• AI-powered note generation from articles
• Browser extension for automated publishing
• Collaboration features for connecting with other writers

2. Your Account & Subscription

2.1 User Accounts

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

2.2 Subscription and Payment

StackBuddy offers both free and paid subscription plans:

• Free Plan: Limited access to basic features
• Pro Plan: Full access to all features including AI generation and advanced scheduling

Payment is processed through LemonSqueezy. Subscriptions are billed monthly or annually as selected. You may cancel your subscription at any time, but no refunds will be provided for partial subscription periods.

3. Key Features & Your Responsibilities

3.1 Use of AI Features

Our AI-powered note generation feature uses OpenAI's services to create content based on your input. By using this feature, you acknowledge that:

• AI-generated content is provided as a starting point and should be reviewed and edited before publishing
• You are responsible for the content you publish, regardless of whether it was AI-generated
• AI-generated content may not always be accurate, appropriate, or fit for your specific needs
• We make no warranties about the quality, accuracy, or suitability of AI-generated content

3.2 Browser Extension

The StackBuddy browser extension automates the publishing of your scheduled notes to Substack. By using the extension, you:

• Grant the extension permission to interact with Substack on your behalf
• Understand that your browser must be open for scheduled notes to be published
• Acknowledge that publishing happens locally in your browser and we do not store your Substack credentials
• Are responsible for reviewing scheduled content before it is published

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Violate Substack's Terms of Service or Community Guidelines
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use the Service to transmit spam, malware, or other harmful content
• Scrape, data mine, or use automated systems to access the Service (except our official extension)
• Share your account credentials with others
• Resell or redistribute the Service without permission

5. Intellectual Property & Third Parties

5.1 Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are owned by Patrick God and are protected by international copyright, trademark, and other intellectual property laws.

You retain all rights to the content you create and publish through the Service. By using the Service, you grant us a license to store, process, and display your content solely for the purpose of providing the Service to you.

5.2 Third-Party Services

StackBuddy integrates with third-party services including:

• Substack: For publishing notes
• OpenAI: For AI-powered content generation
• LemonSqueezy: For payment processing

Your use of these services is subject to their respective terms and conditions. We are not responsible for the availability, functionality, or policies of third-party services.

5.3 Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

6. Service & Liability

6.1 Service Availability

We strive to provide reliable service, but we do not guarantee that:

• The Service will be available at all times without interruption
• The Service will be error-free or secure
• All scheduled notes will be published exactly on time
• AI-generated content will meet your expectations

We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

6.2 Limitation of Liability

To the fullest extent permitted by law, Patrick God shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any unauthorized access to or use of your content
• Any errors, mistakes, or inaccuracies in AI-generated content
• Missed publishing schedules or technical failures
• Any interaction with third-party services

6.3 Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Enforcement & Termination

7.1 Indemnification

You agree to indemnify, defend, and hold harmless Patrick God from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you publish through the Service

7.2 Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

You may cancel your account at any time by contacting us. Upon cancellation, you will lose access to all features and data associated with your account.

7.3 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

8. Governing Law

8.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Germany.

8.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
